Québec renters: why most security deposits are illegal—and what to do instead

What landlords can generally demand up front in Québec

The first payment period’s rent — and not more than one month if that period is longer — plus a properly completed lease. Identification and references are ordinary. A lessor who wants first, last, and damage is importing Ontario slang. Use the three-province planner if you are moving from Toronto or Vancouver so you do not over-budget or overpay.

Damage deposits, key money, and post-dated cheque issues (high-level)

Article 1904 groups the extras: amounts other than rent as a deposit, extra instalments, postdated instruments. TAL repeats that a lessor may not require a security or key deposit as a condition. A clause in the lease that says otherwise is the kind of clause the Tribunal treats as invalid. How to refuse an illegal deposit without losing the unit

Hello [name], I can send a complete application and the first month’s rent as the Civil Code and TAL allow. I cannot send a damage deposit, last-month deposit, or postdated cheques (article 1904). Happy to provide references today and sign the mandatory lease form.

You are asking to rent lawfully. Some lessors will move on. That is cheaper than parking $1,500 you must later recover. A same-day package and a French cover paragraph help you compete without the cheque.

Ontario 2026 last-month interest is 2.1%. B.C. 2026 deposit interest is 0% with a 15-day return clock. Those are the other provinces’ problems. Yours is not handing over the extra $2,200 in the first place.
