Key money and application fees in Canada: a province-by-province savings guide

Competitive markets normalize illegal fees as “everyone pays this.” The statute does not care that 40 people applied. Ontario, B.C., and Québec each treat extra cash besides the lawful deposit or first month as a problem category. Paying $800 to “win” a unit is how you fund someone else’s Kijiji business — and you may still lose the keys.

This is a cash-saved map, not litigation theatre. It is not legal advice.

Key takeaways

  • Rebrands: application, credit check, holding, key money, furniture buy-in, admin, “damage” in Ontario/Québec clothing.
  • B.C.: no fee to process an application; deposit ≤ half a month. Ontario: last-month rent, not extras. Québec: no exacted deposit (1904).
  • Atlantic and Prairie offices exist — do not paste these three paragraphs onto Halifax or Calgary without checking.
  • Refuse in writing. Compete with a package, not an e-transfer.
  • Walking away is often cheaper than paying a vanishing hold. Recover if you already paid (T1 / RTB / TAL overview).

Common fee names landlords use to rebrand illegal charges

Same money, friendlier labels: application fee, credit-check fee (marked up), holding deposit, key money, fob deposit far above replacement cost, furniture “buy-in,” cleaning fee collected on day one, pet fee (especially a monthly B.C. pet charge), lease-preparation or admin fee. If it is not rent and not the lawful deposit, slow down. Photos of a nice kitchen do not legalize the wire.

Rebranded landlord fees, lawful cash instead, and walk-away math on an $800 holding fee.

Atlantic and Prairie notes at a high level

These three snapshots are not a national code. Alberta typically caps a security deposit at one month’s rent — still not an application fee. Other Prairie and Atlantic provinces have their own residential tenancy offices and deposit caps. Before you import Ontario “first and last” or a B.C. half-month into Halifax, Winnipeg, or Saskatoon, find that province’s official deposits-and-fees page. This paragraph will not invent those statutes.

Scripts to refuse fees without burning the application

Hello [name], I can provide a complete application and the deposit / first month [your province] allows. I cannot send an application, holding, or key fee. References and a credit disclosure I pulled are attached. Happy to view again today.

Cite the page you used. You are not giving a speech about justice. If they ghost you for refusing $400, you did not want that landlord on month four either.

When walking away is cheaper than paying

Add the junk fee to the next unit’s lawful deposit and one more week of hunting (transit, time off work). An $800 hold that is “non-refundable if you fail screening” is often more expensive than missing a unit. Safety and scam patterns (overseas owner, lockbox before viewing) are walk-now, not a spreadsheet — see hunting without scams.

How to document and seek recovery (overview)

Keep the listing, texts, e-transfer, and a one-page timeline. Ask in writing with a date. Then:

  • Ontario: T1 themes for illegal charges (confirm current LTB instructions and time limits).
  • B.C.: RTB dispute resolution; overcharged deposits can sometimes be withheld from the next rent after you write — carefully, and only the overage.
  • Québec: TAL path for amounts a lessor was not allowed to exact.

This is not a filing kit. Clinics exist because forms are fiddly.

Shareable one-page fee checklist for roommates

  1. Province of the unit (not the landlord’s hometown).
  2. Lawful deposit or first-month amount, in dollars.
  3. Any extra ask: name, amount, who it is payable to.
  4. Official page you checked (LTB / RTB / TAL / other).
  5. Decision: refuse / walk / write to recover.
  6. Who sends the email (one voice).

Roommates who “just e-transferred to hold it” without this list are how $800 becomes a house-chat war. Put the checklist in the shared notes before the Saturday hunt.

Frequently asked questions

Are application fees legal in Canada?

B.C. says landlords cannot charge to process an application. Ontario’s rental-offences material flags extra fees. Québec bars extra amounts besides rent. Treat application, holding, and credit-check markups as a refuse in those three unless you have current official text that says otherwise for your facts.

What is key money?

A premium to obtain the keys or the lease — sometimes called a furniture buy-in, an “administration fee,” or “taking it off Kijiji.” In the big three provinces it is a problem category, not a market custom you must fund.

When is walking away cheaper than paying?

When the fee plus a new lawful deposit elsewhere exceeds one more week of hunting, or when paying would fund a tenancy you cannot enforce. An $800 “hold” that vanishes if you do not qualify is a skip.

What if I already paid?

Document the listing and the transfer. Ask in writing. Then the board path: Ontario T1 themes, B.C. RTB, Québec TAL. This is not a filing kit.

Is this legal advice?

No. Atlantic and Prairie rules differ. Find that province’s residential tenancy office before you import Ontario/B.C./Québec language.
