A holiday set that says it is worth several hundred dollars is a representation about price. It is not a list of what your household will use. This page shows the arithmetic: size in the set, full-size size, full-size price, a pro-rated figure, and a yes or no on whether you would use it. How 'value' claims are calculated
Subsections 74.01(2) and 74.01(3) of the Competition Act, as set out in the Bureau’s ordinary-price guidelines, deal with a representation to the public about the price at which a product is ordinarily supplied. One test is whether a substantial volume was sold at that price or higher within a reasonable period. The other is whether the product was offered in good faith at that price or higher for a substantial period. The guidelines are dated 16 Oct 2009. The page checked 29 Sep 2026 says the Bureau is reviewing them after amendments to the Act, so this article does not treat the 2009 penalty figures as a current maximum. It is not legal advice.
A gift-set line that says the contents are worth a stated sum is the kind of representation to read against those tests, and against the literal impression plus the general impression, which the guidelines say both count. Write down the claimed number. Then rebuild it from full-size prices you can see that week. If you cannot reproduce the claim from prices on offer, the claim is not your worksheet. A cash-back portal or a discounted gift card changes what you pay for the set. It does not change the claimed figure. The gift-card guide is the stacking method. It is not a reason to buy samples you will not open.
Sample-size vs full-size cost per ml
Pro-rated value of one item is the full-size price multiplied by the size in the set, divided by the full-size size. Use millilitres or grams, and do not mix them. Example with made-up inputs. A moisturiser at 15 millilitres in the set, against a 50 millilitre full size priced at 80 dollars, is 80 times 15 divided by 50, which is 24 dollars. The seller’s claim in the same example is 400 dollars. The four full-size prices sum to 356 dollars, which is already short of 400. That gap is the point of the worksheet: the claim and the sum you can rebuild are allowed to disagree, and when they do you keep the sum you can rebuild. Cost per millilitre of a sample is not the cost per millilitre of the full size. A tiny bottle can look generous on a door and still be a poor substitute for the bottle you would have bought.
Timing: early release vs Black Friday and Boxing Day markdowns
Record three dates: the day the set appears, the week of Black Friday on 27 Nov 2026, and the week of Boxing Day on 26 Dec 2026. Those two holidays are calendar dates only. The method is to check the same seller again, not to assume a sale.
If the same seller drops the price inside a published price-adjustment window, that is the price-adjustment guide, not a second calendar. Compare 51 dollars with the price you would actually pay for the set, not with the 400 dollar claim. If the set costs more than 51 dollars in this example, the claim can be large and the set can still fail. Your numbers replace both. A set you are giving away is a different question: the yes column is what the recipient will use, which you often do not know. When you do not know, the real value is the price of a product you have watched them finish, not the sum of doors.
Splitting sets into multiple gifts
Splitting a set into several gifts can turn one unused calendar into two presents someone will open. It can also end the return. Do it only after you have read whether the seller treats the set as one unit. Shoppers’ returns page does not mention gift sets as their own class. It does say clearance and products marked final sale are final, and that a general refund or exchange needs the original receipt within 30 days. If you break the box before you know that rule, you may be past the only window you had.
Keep the outer box and the receipt until that window ends. Put each item you give away in its own labelled container so the shade name stays with it. Do not decant a sample into an unlabelled jar.
